The Court of Justice of the European Union (CJEU) declared in its preliminary ruling C 3/17 of 2018 that it is unconstitutional to restrict the freedom to supply services under Article 56 TFEU by requiring an established casino in Hungary to be granted an online casino operating license. The Hungarian Ministry of Justice said in a press release that it will keep using administrative and criminal legal measures to prosecute unlicensed gaming operators in the wake of this ruling. The CJEU’s rulings must be applied by Hungarian courts in specific domestic instances since the legislative requirements based on the CJEU’s ruling are still in effect. For “technical reasons,” the gaming regulator has halted its program of blocking unregistered gaming websites. This indicates that Hungary can currently access the majority of international gaming and betting websites.
